This Vacation Rental Agreement ("Agreement") is entered into between the Host and the Guest.
Definitions
Guest - The individual or group renting and staying at the property. They are temporary occupations who have agreed to the terms and conditions set forth by the host for the duration of the stay.
Host - The property owner or someone legally authorised to rent the property. The host is responsible for providing the accommodation, ensuring the property is well-maintained, and setting the rules and regulations that the guest.
Property - Refers to the physical space being rented out. In this case, it refers to the 2nd floor of a house located at Numero 3 Caminho Col. Machado, 9270 Seixal, Portugal. It encompasses the living space located on the 2nd floor, including a kitchen, bathroom, double bedroom, living room, storage room and a balcony in addition to the outside staircase that provides access to the living space.
Booking - refers to the specific arrangement or reservation made by a Guest to rent the Property for a specified period. It includes the dates of the stay, the agreed-upon rental rate, any additional fees, and the terms and conditions agreed upon by both the Guest and the Host at the time the Booking is made.
1. Rental Payment
1.1 The Guest agrees to pay the total rental fee in advance, as per the EURO values displayed at the time of the Booking with the payment methods made available on www.sunrise-bay.net and www.airbnb.com/h/sunrise-bay-Madeira and www.booking.com/hotel/pt/modern-flat-with-stunning-views.
2. Cancellation & Refund Policy
2.1 Bookings made using the Flexible cancellation policy are eligible for a full refund if cancelled 5 days or more before the check-in date.
2.2 Booking cancellations made within 5 days of the check-in date are not eligible for refunds. Guests should ensure they have purchased Travel Insurance to cover such inconveniences.
2.3 Bookings made using the non-refundable policy are not subject to any refund.
2.4 Subject to availability and at the Host's sole discretion, a Booking can be transferred to an alternative date.
2.5 In such circumstances, the booking value may change to reflect higher seasonal rates, as applicable. The Guest will be provided with such information in this event.
3. House Rules
3.1 The Guest acknowledges and agrees to adhere to the house rules outlined in this agreement. These rules are designed to ensure a safe, comfortable and enjoyable stay for all guests. Failure to comply with these rules may result in the termination of this agreement, see Clause 9 - Termination, and the Guest immediately vacating the property.
3.2 Smoking - Smoking is not allowed inside the property. It is possible to smoke outside the property, however, the Guest should pay particular attention to placing cigarette buts/filters in the bin to ensure the property is kept clean and to avoid starting any fires, especially during hot days.
3.3 Occupancy Limit - The property allows for a maximum of 4 people to stay at any time during a Booking. Under no circumstances should more than 4 persons be on the property at any given time.
3.4 Pets - No pets are permitted to be present at the property at any time during the Booking.
3.5 Parties - The property sits above the home of the Host family and as such parties are strictly forgiven.
3.6 - Quiet Time - to ensure a peaceful and enjoyable environment for both Guests and neighbours, the Guest agrees to minimise loud noises, music, and any other activities that may create disturbances for the other floors in the house or nearby properties. Quiet Time takes effect at 10:00 PM and 08:00 AM local time.
3.7 Parking - The property has no allocated parking. Free parking on the street near the property is available to the public and the Guest, at their sole risk, can park where available space exists. Guest should pay particular care in parking in a considerate manner, away from neighbour's entrances or garages
3.8 Security - The Guest is responsible for ensuring the security of the property during their Booking. Windows and doors must be locked when the property is left unattended during the booking.
3.9 Guest Responsibility - The Guest agrees to be held liable for any losses or damages incurred to the Host through wilful negligence during the duration of the Booking.
4. Maintenance and Repairs
4.1 The Host will make every effort to ensure the property is in good condition to allow the Guest to enjoy their stay at the property and endeavour to complete any repairs or maintenance before a booking commences.
4.2 The Guest agrees to promptly notify the Host, through WhatsApp, Airbnb or Sunrise-bay.net, of any issues or damage to the property during the duration of the Booking.
4.3 If access to the property is required for emergency repairs or maintenance, every effort will be made to provide advance notice to the Guest, unless immediate access is required due to emergencies, safety concerns or the need to prevent damage to the property. The Guest agrees to cooperate with the Host and reasonable requests concerning this clause.
5. Liability
5.1 The Host shall not be held liable for any accidents, injuries or illnesses that may occur during the Guest Booking at the property. By making a Booking, the Guest acknowledges and agrees that they assume all risks associated with the use of the property and its amenities. It is the Guest's responsibility to exercise caution and adhere to all safety guidelines provided by the Host.
5.2 The Host is not responsible for any loss, theft, or damage to the Guest's personal belongings during the Booking. The Guest is encouraged to secure their valuables and report any security concerns promptly to the Host.
5.3 The Guest agrees to indemnify and hold the Host harmless from any claims, including but not limited to those related to personal injury, loss, or damage to the property, arising out of the Guest's use and occupancy of the Property.
5.4 In the event, that the property becomes uninhabitable due to circumstances beyond the Host's control, including but not limited to natural disasters or unforeseen emergencies, the Host shall not be held responsible for providing alternative accommodation or any resulting inconvenience or expenses incurred by the Guest.
6. Termination
6.1 The Host reserves the right to terminate this agreement and evict the Guest under the following circumstances.
6.2 Violation of Terms - If the Guest fails to comply with the terms and conditions outlined in this agreement.
6.3 Illegal Activities - If the Guest engages in any illegal activities on the premises, including but not limited to the utilisation of illicit drugs, the Host has the right to terminate this agreement immediately, and local authorities may be contacted.
6.4 Disturbances or Nuisance - If the Guest's actions or behaviour causes a disturbance nuisance or inconvenience to neighbours.
6.5 Damage to Property - In the event of wilful or negligent damage to the property by the Guest, the Host reserves the right to terminate this agreement.
6.6 Emergency Situations - In cases of emergencies, such as but not limited to natural disasters, situations where the property becomes uninhabitable or unsafe, the Host may terminate the agreement for the safety of the Guest.
6.7 Eviction Process - In the event of termination, the Guest agrees to vacate the property immediately. Any remaining balance of the rental fee will be forfeited. If the eviction becomes necessary due to the Guest's actions, the Guest shall not be entitled to a refund for the remaining Booking period. The Host will make reasonable efforts to provide reasonable efforts to provide notice to the Guest before termination, except in cases of emergency or illegal activities.
7. Governing Laws
7.1 This agreement shall be governed and construed per the laws of Portugal.
Both parties acknowledge and agree to the terms and conditions set out in this Vacation Rental Agreement. This is considered in effect from the moment the Guest submits a booking and the Host accepts the booking.
